– The customer undertakes to return the premises and equipment entrusted to him in the condition in which he received them, their use being presumed to be in accordance with the use for which it was intended.

– Any technical problem or damage to the premises must be reported to the studio manager Sophie Thuilliez

– The customer is solely responsible for the deterioration or even the destruction (total or partial) of the premises and equipment made available to him.

– Background paper and any other consumables will be charged extra.

– The customer is required to take out insurance against any risk for which it could incur liability vis-à-vis the company ECOM34 or its personnel.

– The rental takes effect when the customer or his agent takes possession of the rented property on the lessor's premises. Custody will be transferred when the equipment is handed over to the customer, who will assume full responsibility for it, the latter declaring the use as a “good father”.

– The customer declares that he/she acknowledges having personally had the opportunity to check the rented equipment, to find it to be in accordance with his/her needs and in good working order, clean, properly maintained, and in compliance with all regulatory requirements.

– The customer undertakes to insure the rented property against any harmful consequences that may occur in the context of the tenant's use of the rented property. The tenant's obligation to insure does not entail any waiver by ECOM34 Company to take any action against the customer, where applicable.

– The loan or subletting of rented equipment is strictly prohibited, except with the prior written agreement of ECOM34.

– The customer hereby undertakes to return the equipment entrusted to him in the condition in which he received it, this condition being presumed to be in conformity with the use for which it is intended.

– The customer agrees to report to ECOM34 any technical incident occurring to the equipment. In the event of deterioration or destruction of the rented equipment, the repair or replacement costs will be fully borne by the tenant. The operations necessary for the repair or replacement will be carried out exclusively by the company ECOM34, the tenant bearing the entire financial burden.

– In the event of theft, the customer must, under his responsibility, make a declaration as soon as possible to the nearest police station and to his insurance company.

LIMITATION OF LIABILITY CLAUSE

– ECOM34 cannot be held responsible for any direct or indirect damage suffered by the tenant in the event of inability to use the studio or equipment on the scheduled day of the shoot, due to any reason beyond its control.
In this case, the company ECOM34 undertakes to find another date in agreement with the tenant, no compensation will be due.

– ECOM34 will not incur any liability towards the customer in the event of breakdown or malfunction of the rented property.

– ECOM34 cannot be held responsible in any way for any damage, direct or indirect, incident or accident occurring during the use of the rented property.

– ECOM34 may also not be held responsible for any damage, direct or indirect, incident or accident suffered by any property which could be entrusted to the client's personnel for any reason whatsoever, or which these same personnel could be required to handle, the occasion of the use of the rented property.

– Any risk of bodily harm, loss, theft or deterioration of the rented property is the responsibility of the tenant. ECOM34 is not responsible for clothing and objects of any nature or value left before, during and after the shooting by the tenant in the rented property.

RESERVATIONS


To definitively confirm a reservation, the quote must be returned to us signed, with the words “good for agreement” and a deposit of 50% of the amount of the quote no later than 3 days before the day of the shoot.


CANCELATION

In case of cancellation more than 3 working days (3 business days) before the rental day, the 50% deposit is refunded.
In case of cancellation less than 3 working days (3 business days) before the rental day, the 50% deposit is not refunded.
In case of cancellation on the day of rental, the entire rental is due.

PRICES

– The rental prices set by the company ECOM34 are determined based on the rates in effect on the day of booking.

– These rates are increased for weekend (and public holiday) rentals and services as well as for overtime and night hours.

– The prices charged by the company ECOM34 may be subject to revision at any time, depending on the economic conditions in force.

Studio rental is billable:

– Per hour at €70 excluding tax. (the first)

– Per additional hour at €50 excluding tax. (after the first and the 8-hour day and 4-hour half-day packages.)

– Per ½ day between 8 a.m. and 8 p.m. (i.e. 4 continuous hours) package at €200 from Monday to Friday & €350 on weekends & public holidays

– Per day between 8 a.m. and 8 p.m. (i.e. 7 hours excluding 1 hour for lunch or 8 continuous hours) at €370 from Monday to Friday & €450 on weekends and public holidays.

Increases:

– Before 8 a.m. and after 8 p.m. 25% supplement.

– Acceptance of a quote requires acceptance of our general rental conditions.

– Any quote must be validated by return duly signed, dated and marked “GOOD FOR AGREEMENT” as well as by a deposit of 50% of the rental price (deducted from the final invoice) at the latest 3 days before the day of the rental.

– Any reservation or quote not respecting these conditions will not be taken into account.

– Payment of the remaining balance is made at the end of the rental – by credit card or in cash – in exchange for the invoice.

– Our invoices are payable at our Head Office, either in cash on the invoice date, or by draft accepted 7 days after the invoice date.

– In the event of non-payment of our invoices at the specified times, the amounts due will bear interest automatically and without formal notice.

– Discount for early payment: none

– In the event of late payment, penalties will be applied, calculated on the basis of the interest rate applied by the ECB plus 10 points.

– Fixed compensation of €40 for recovery costs, in the event of late payment.

JURISDICTION

– In the event of a dispute, only the courts of PARIS will have jurisdiction, including in the event of multiple defendants and third-party claims.
